Rev. C.B. Ragsdale and R.L. Barber, charged with Perjury in swearing to false Affidavits in the Frank Case, were Saturday upon the Docket of Judge Ben H. Hill's Branch of the Superior Court for trial Monday. These Defendants have been on the Docket for trial three times before, but their Cases have never actually been begun in Court.

FRANK WILL PROBABLY BE RESENTENCED MONDAY

Judgment of U. S. Supreme Court Made Judgment of District Court

Everything is in readiness for the Resentencing of Leo M. Frank; all that now remains to be done is for Judge Ben H. Hill of Fulton Superior Court to set a time, this will probably be Monday.

Clerk O.C. Fuller of the United States District Court, acting for Solicitor General Dorsey of Fulton Superior Court, Saturday morning drew up an Order making the Judgment of the United States Supreme Court in refusing Frank's Appeal for a Writ of Habeas Corpus the Judgment of the District Court. Judge W.T. Newman signed this Order; a certified Copy was made for the Solicitor's Office; Assistant Solicitor E.A. Stephens went to the Federal Building and got this Copy; Solicitor Dorsey then had the Order filed with the Clerk of the Superior Court. No other formal legal steps will have to be taken before the Resentencing, as Solicitor Dorsey filed some days ago the necessary Application for a Habeas Corpus to bring Frank from the Jail into Judge Hill's Court.

Judge W. T. Newman's Order reads:

"Leo M. Frank vs. C. Wheeler Mangum, Sheriff; Habeas Corpus Appeal to the Supreme Court of the United States."

"The Mandate of the Supreme Court of the United States affirming the final Order of this Court refusing the Writ of Habeas Corpus in the above stated Case having been received by the Clerk of this Court;"

"It is hereby ordered and adjudged that the said Mandate be filed and it is hereby made the Judgment of this Court with Costs against the said Leo M. Frank, for which let Execution issue."

"In Open Court, Atlanta, Ga., this the 8th day of May, A.D., 1915."
