State of Georgia, EXHIBIT V.

Vs.
Leo M. Frank.

Personally appeared Marcus Benbenisty, who on oath
says that he was standing outside of the court house on Friday
afternoon, August 23rd, at about 1:30, and I saw the jury
come out of the court room. Soon after the jury came out of
the court room. Mr. Dorsey came out, and the crowd set up cheer-
ing and yelling "Hurrah for Dorsey".

At the time of the yelling and cheering the jury was just
crossing the street towards the Barbee Supply Company, which
is next to the Kaiser Building. That in the opinion of the
deponent there was about a thousand people crowding about the
court room.
