A witness testified that he was about two miles east of Ferguson, in company with two other men, all riding horseback, one of whom was Braff. The witness was on his way to St. Louis with Mr. Hervey. This was around 2 o'clock in the afternoon. The witness remained overnight at Warrenton, got an early start the next morning, and as he passed Hutchinson's, he saw Worrell sitting on the steps. Worrell called out to the witness and said, "You have got an early start." The witness recognizes the prisoner as the same man.

Mr. Stewart, a resident of Warrenton, stated that he knew Gordon. On the 24th of January, around 4 or 4:30 in the afternoon, he saw Gordon as he passed through Warrenton. Gordon was riding a chestnut sorrel horse, accompanied by two men. Mr. Stewart recognizes the prisoner and Braff as the men; they stopped for some time at the door of Sander's hotel and then rode off together, traveling east.

Mr. Camp, who resides in the west end of Warrenton, reported that he saw Gordon in company with two men, all on horseback, on the 24th of January, between 4 and 5 o'clock in the afternoon. Mr. Camp was personally acquainted with Gordon. Gordon was on a chestnut sorrel horse and rode up to Mr. Camp's fence, speaking to him. Mr. Camp asked him to stay overnight, but Gordon declined, saying he was going to Hutchinson's. It was snowing when they arrived, and about the time they left, it started snowing again, continuing most of that day. It is about 40 miles from Mr. Hutchinson's house to St. Charles.
